Australian Shepherd Sales Contract

 

I, the undersigned seller have on this day ____________, sold  the below named Australian Shepherd to the undersigned buyer for the price of ___________, the terms of which sale are as follows:

A. To the best of the knowledge of the breeder/seller, this dog is in healthy, sound condition at the time of sale, and free of any communicable diseases. 

B. This dog is guaranteed against the following inherited defects, for the periods of time, stated.

(1) Hip Dysplasia, should it be found before twenty-six months of age, which allows two months after the second birthday, for the owners to do ex-rays for OFA certification.  

(2) Any inherited eye defects which are CERF’d for, routinely, on an annual basis, through the second birthday, and Juvenile Cataracts which can still be present and become visible as late as seven or eight years of age.

(3) Incorrect bite, overshot or undershot, and any missing teeth which are not pre-molars, as well as any number over two missing pre-molars, provided that they are reported to the breeder before the second birthday.  (Missing pre-molars will not prevent a dog from finishing, but over two does make it more difficult.)

In the event that any one of these problems should arise, the puppy shall be replaced with a puppy of equal or better quality, from the next available litter, provided that either this dog has been returned to the breeder, or the original buyer has provided proof of spay/neuter by a licensed, reputable veterinarian. The above guarantees shall become null and void after 26 months of age, unless otherwise stated, as in the case of Juvenile Cataracts, in the belief that any other problems would have already been in evidence by that time.  

If said dog is bred before hips and eye's are tested and found to be clear, this contract becomes null and void

All shipping costs related to any dog being purchased, as well as in relationship to any dog being replaced for any reason, are the responsibility of the buyer.

Dogs bred exclusively by me shall carry the kennel name "Ridgerunner" at the beginning or at the end of the name.

Should this dog die for any reason, whatsoever, during the first 48 hours from time of purchase/shipment, whichever came last, the dog shall still be paid for in full, and a replacement puppy shall be provided, of equal or better quality, provided that a licensed veterinarian offers written proof that the cause of death was due to a pre-existing, but unknown condition.  Ridgerunner Kennels shall not be responsible for death due to negligence or carelessness of any airline or other live animal carrier, it's agents or employees, or the buyer.
